By accessing Wap2b, a service provided by Octet Logic, you are agreeing to the following Terms of Use. Please read them carefully before using our platform.
1. Acceptance of Terms
By using or accessing any of the services provided via Wap2b, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use our services.
2. Eligibility
You must be at least 18 years old to use our services. By using the services, you confirm that you are 18 years or older and have the legal capacity to enter into a binding contract.
3. Services Provided
Octet Logic offers businesses access to Wap2b, a platform that integrates your business with the WhatsApp Business API and Instagram Professional accounts (Business or Creator), both offered by Meta, to provide messaging and automation services such as:
- Customer support
- Marketing and promotional messages
- Order status updates
- Notifications
- Inbox management and customer communications
- AI-powered automation and lead filtering
The platform also includes AI-powered agents such as w2Shield (Instagram comment and DM moderation), Inbox AI (Instagram inbox automation), Support Agent (WhatsApp customer support automation), and Commerce Agent (WhatsApp-based product catalog and order management). These AI agents operate based on the configuration and training data you provide through your account.
4. Account Registration
To access our services, you must create an account. During registration, you must provide accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
5. Prohibited Use
You agree not to use our services for any unlawful or unauthorized purpose, including:
- Sending unsolicited marketing messages or spam
- Engaging in fraudulent, illegal, or harmful activities
- Violating any applicable laws or regulations
- Using automated bots or scripts to abuse the platform
6. User Data and Privacy
We respect your privacy and are committed to protecting your data. Please refer to our Privacy Policy for details on how we collect, use, and protect your personal data.
7. Content Ownership
- User Content: You retain ownership of the content you upload or send via our services. By using the services, you grant Octet Logic a limited license to process and display such content solely to provide the services.
- Service Content: All content, technology, and software related to our platform are the property of Octet Logic or its licensors. You are granted a limited, non-exclusive license to use the services for business purposes, subject to compliance with these Terms.
8. Data Security
We take reasonable steps to protect your data from unauthorized access, loss, or theft. However, you acknowledge that no system is completely secure and we cannot guarantee absolute protection.
9. Third-Party Services
Our services connect with third-party platforms including WhatsApp and Instagram (offered by Meta), payment gateway providers (e.g., Razorpay), and cloud infrastructure services. We are not responsible for the content, privacy practices, or policies of these third parties.
By connecting your WhatsApp Business or Instagram Professional account to Wap2b, you confirm that you comply with Meta's Platform Terms, WhatsApp Business Policy, and Instagram Platform Policy. You are solely responsible for ensuring that your use of messaging, automation, and AI features through Wap2b adheres to Meta's guidelines. Violation of Meta's policies may result in suspension of your connected accounts by Meta, for which Octet Logic bears no liability.
10. Service Interruptions
While we strive to provide continuous service, Octet Logic does not guarantee that the service will be uninterrupted or error-free. We may suspend or discontinue services at any time without prior notice. Scheduled maintenance windows may occur periodically to improve performance, apply security updates, or introduce new features. Where possible, we will provide advance notice of planned downtime. Unplanned outages caused by third-party providers (including Meta, cloud hosting, or payment gateways) are outside our control.
11. Subscriptions and Billing
Access to Wap2b features requires an active subscription plan. Subscription plans are offered on a monthly basis and may vary by region and currency. All prices are listed exclusive of applicable taxes (e.g., GST at 18% for users in India) unless stated otherwise.
- Plan Selection: You may choose from the available subscription plans at the time of purchase. Each plan specifies the included features, channel access (WhatsApp, Instagram, or both), and pricing.
- Renewal: Subscriptions do not auto-renew. You must manually renew your subscription before or after the expiry date to continue using the services. If your subscription expires, access to paid features will be suspended until a new subscription is activated.
- Cancellation: You may choose not to renew your subscription at any time. There is no cancellation fee. Your access will remain active until the end of your current billing period.
- Refunds: Payments for subscription plans are non-refundable once the subscription period has begun. If you experience a technical issue preventing access to paid features, please contact support for resolution. Refund requests are reviewed on a case-by-case basis.
12. Add-Ons
In addition to subscription plans, Wap2b offers optional add-ons that extend your platform capabilities. Add-ons include, but are not limited to, additional message or engagement credit packs and supplementary feature modules.
- Prerequisite: Add-ons require an active subscription plan. Add-ons cannot be purchased or used independently without a valid subscription.
- Billing: Add-ons are billed separately at the time of purchase and are charged alongside your subscription.
- Validity: Usage-based add-ons (e.g., credit packs) remain valid until consumed or until your active subscription expires, whichever comes first. Feature-based add-ons expire with your subscription period.
- Non-refundable: Add-on purchases are non-refundable once activated.
13. Free Trial
Wap2b may offer a one-time free trial to new users. The free trial provides limited access to platform features for a period of 7 days from the date of activation.
- The free trial is available once per user account and cannot be renewed or extended.
- At the end of the trial period, access to paid features will be suspended. To continue using the services, you must purchase a subscription plan.
- No payment information is required to start a free trial, and you will not be automatically charged at the end of the trial period.
- Octet Logic reserves the right to modify, limit, or discontinue the free trial offer at any time without prior notice.
14. Message Credits and Usage Limits
Certain features on Wap2b operate on a credit-based usage model. Credits are consumed when performing actions such as sending WhatsApp messages, processing Instagram comments or DMs through AI agents, or executing broadcast campaigns.
- Each subscription plan includes a predefined allocation of credits. The number of credits included varies by plan and is displayed at the time of purchase.
- When your credits are exhausted, the associated features will become unavailable until additional credits are purchased via an add-on or your subscription is renewed with a fresh credit allocation.
- Unused credits do not carry over between subscription periods unless explicitly stated for a specific plan or add-on.
- Credit consumption rates may vary by action type and channel. Detailed credit usage information is available in your account dashboard.
15. AI-Generated Content
Wap2b provides AI-powered features including automated replies, comment moderation, lead filtering, and conversational agents. By using these features, you acknowledge and agree to the following:
- AI-generated responses are produced by machine learning models and may not always be accurate, complete, or appropriate for your specific use case. You are responsible for reviewing and monitoring AI outputs, especially before they are sent to your customers.
- Octet Logic does not guarantee the accuracy, reliability, or suitability of any AI-generated content. AI-generated content should not be considered professional, legal, medical, or financial advice.
- You are solely responsible for the content sent through your connected WhatsApp and Instagram accounts, including content generated by AI agents configured under your account.
- AI agents operate based on the training data, knowledge base, and configuration you provide. The quality and relevance of AI responses depend on the accuracy of the information you supply.
- Octet Logic shall not be held liable for any damages, losses, or disputes arising from AI-generated content delivered to your customers or contacts.
16. Limitation of Liability
In no event shall Octet Logic or its partners, affiliates, or employees be liable for any indirect, incidental, special, or consequential damages, including loss of profits or data, arising from or related to the use of our services.
17. Indemnification
You agree to indemnify, defend, and hold harmless Octet Logic, its affiliates, employees, and partners from any claims or damages resulting from your use of the services or violation of these Terms of Use.
18. Modifications
We may update or modify these Terms of Use at any time. Changes take effect immediately upon posting on our website. Continued use of the services indicates acceptance of the revised Terms.
19. Termination and Data Retention
We may suspend or terminate your access if you violate these Terms. Upon termination, all rights and licenses granted to you under these Terms will immediately cease.
Following account termination or deletion, Octet Logic will retain your data for a period of up to 90 days to allow for account recovery or dispute resolution. After this retention period, your personal data, message history, AI training data, and associated account information will be permanently deleted from our systems, except where retention is required by applicable law or for legitimate business purposes (e.g., billing records, fraud prevention). You may request early deletion of your data by contacting support, subject to legal retention obligations.
20. Payment Gateways
Payments are processed securely by third-party gateways (e.g., Razorpay, PayPal). We do not store your payment card details on our servers. All payment information is handled directly by the payment processor in accordance with PCI-DSS standards. Refunds and payment disputes are governed by the respective payment provider's policies in addition to Section 11 of these Terms.
21. Governing Law
These terms are governed by the laws of the Republic of India, specifically the State of Telangana and the City of Hyderabad, without regard to conflict-of-law principles.
